OPIPA.com is a self-regulated online group of limited number of professional artists. For the chance to exhibit their work on OPIPA.com (hereinafter “OPIPA”) artists have to apply for membership filling Request Form. All new requests for membership are subject of approval of OPIPAs’ full members by voting for or against every new inclusion. Thus OPIPA keep up the quality of the group and control total number of its members.
All web-based services ("Services") provided to you by OPIPA are provided to you subject to the following Terms & General Conditions. Do not use or access any portions of OPIPA or use any Services offered on OPIPA, if you do not agree to be bound by these Terms & General Conditions. Terms & General Conditions shall be applicable to your use of OPIPA and any agreement or (other) arrangement between you and us in connection with OPIPA or its Services.
To become a member (hereinafter “Member”) of OPIPA you have to be professional artist, who design and produce his work exclusively by hand in his studio and gain a considerable portion of his income from the sale of his art. If you are such of artist you have to supply us online with direction to your work. For this purpose you have to fill in the Request Form. In this form you have to fill your names, email and your website. If you do not have website you have to put a link to your works if they are uploaded somewhere in the network. As well you can upload portfolio or photos, if you prefer or in case you do not have website or any link to your work. In some way or another you have to provide at least 12 works to be your request valid. Please ensure your files end in .JPG, .TIFF, .GIF, .BMP, or .PDF and the image size have to be 72 dpi and up to 800 (x800) pixels.
When you send request, in the course of the 3 days full members of OPIPA will examine and vote your work and after that you have to receive an email with the result. If the member’s decision is positive you will be provided in this email with details for access to easy of use administrative panel and you can start to upload data and images. Reckoning from this date your full membership and Members Year starts and till 3 business days you have to pay your annual membership fee using PayPal. Every artist included in OPIPA pays €35.00 or $50.00 annual membership due reckoned from the date of his inclusion.
2. Membership Year
2.1 Membership Year begins on the date on which payment is received and extends for the subsequent 365 days, at which time it will be subject to renewal.
3. Membership Benefits
By becoming a Member of the OPIPA every artist obtain with a large variety of membership benefits like:
3.1 Own website (“Member’s Website”) with four pages: Gallery, Biography, Events and Contact
3.2 Own subdomain (“Member’s Website”):
c) www. yourfamilyname.opipa.com
3.3 To presents in Member’s Website, in Gallery up to twelve works each with up to three images for details
3.4 To publishes, organizes and updates web contents in his/her Member’s Website without requiring knowledge of program languages
3.5 To keep up-to-date Gallery page with his/her recent works
3.6 To showcases his/her work in Market section when it available for sale
3.7 To has control how visitors contact him/her by provides contact data he/she decides
3.8 Visitors contact with Member directly regarding paid commissions or to by his/her work and Member has full control of this
3.9 Members only directory which contains information on professional employment, commissions, exhibition opportunities and other advantages for artists
3.10 To have high position in search engines results for his/her Member’s Website and thus increase online popularity of his/her art.
4. Registration Data
4.1 In consideration of your possibly membership in OPIPA, you agree to be 18 years or older and:
a) To be professional artist, who design and produce his work exclusively by hand in his studio and gain a considerable portion of his income by selling his art.
b) Provide accurate, current and complete information about you (“Registration Data”) as may be prompted by Request Form on the OPIPA. Registration Data including without limitation, yours first name, last name, email address and website or link to your work.
5. Account Security
5.1 Becoming a Member of OPIPA you will receive a unique User Name and temporary Membership Password. Your Membership Password can and should be updated by you the first time you log in to your Membership Account and periodically thereafter. You are responsible for maintaining the confidentiality of the User Name, Membership Account and Membership Password. You acknowledge and agree that your User Name, Membership Account and Membership Password are personal to you and may not be shared with, or transferred to, any other person or entity.
5.2 You acknowledge and agree that you will be solely responsible for each and every use of your Membership Account, Membership Name and Membership Password, and that we may rely on the use of your Membership Account, Membership Name or Membership Password as conclusive evidence that you have used the OPIPA.
5.3 You agree to:
a) Immediately notify us of any unauthorized use of your Membership Account, Membership Name, Membership Password or any other breach of security
b) Ensure that you exit from your Membership Account at the end of each session using the Logout link provided. We cannot and will not be liable for any loss or damage arising from your failure to comply with this requirement.
c) Be fully responsible for all use of your account and for any actions that take place using your account.
6.1 OPIPA is solely responsible for:
a) Providing every Member with virtual space and Member’s Website for exhibiting their work, displaying their biographical and contact information and other information as to events and upcoming exhibitions of their work in the course of minimum one Membership Year.
b) Providing every Member with possibility to create, manage and change the content, personal data and images in the Member’s Website at any time they want and need to.
6.2 As a Member of OPIPA you are solely responsible for:
a) Providing the visuals of your artwork for display with the required works details.
b) Providing your brief biographical and correct required contact information in your Member’s Website.
c) Selling and shipping of your work. If buyers want to buy any of your work they will contact you directly by email from MARKET section, email from Members’ Website CONTACT page or Artist Contact Form in it.
d) To keep up to date Member’s Content (as defined below) in your Member’s Website and erases any work’s price in a timely manner if the work has been sold in order to remove it from MARKET section.
6.3 Once you are accepted as a Member you required to exhibit with OPIPA for a minimum time of one year.
7. Member Conduct
7.1 Become a Member you agree to not use OPIPA or its Services to:
a) Upload, post or otherwise transmit any information, data, text, software, images, photographs, graphics, video, messages, or other materials (“Member’s Content”) that is unlawful, defamatory, obscene, invasive of another's privacy, hateful or otherwise objectionable.
b) Upload, post or otherwise transmit any Member’s Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information).
c) Upload, post or otherwise transmit any Member’s Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.
d) Upload, post or otherwise transmit any Member’s Content that interferes with or disrupts our Services or servers or networks connected to our Services.
e) Upload, post or otherwise transmit any Member’s Content that in any unlawful manner or in any other manner could damage, disable, overburden or impair OPIPA.
f) Collect email addresses or other contact information of other Member of OPIPA or its Services for the purposes of sending unsolicited emails or other unsolicited communication.
j) Create a false identity on OPIPA or its Services.
8.1 OPIPA is not responsible or liable in any manner for:
a) Any Member’s Content shown in OPIPA or in the Member’s Websites or any links to third party websites.
b) What Member contribute OPIPA or Member’s Website and is not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content or items you may encounter on or in connection with your use of OPIPA.
c) The conduct, whether online or offline, of any Member of OPIPA.
d) Selling or shipping of the works of any Member to buyers. Interested buyers have to contact the Member directly via email if they want to purchase some work.
e) Unlawful printing, downloading, reproduction or distribution of Member’s artwork.
j) Any losses or damages monetary or otherwise from the use or misuse of OPIPA, reliance on OPIPA, interruptions owing to circumstances beyond its control which it has or cancellation of membership.
h) Any links on the OPIPA to third party websites. OPIPA does not warrant the legality, accuracy, or authenticity of content presented by such websites or any products or services offered by third parties.
8.2 OPIPA is not liable to anyone purchasing any product or services from any Member or third party linked to OPIPA.
8.3 OPIPA does not guarantee that the art will be sold even though the presence of MARKET section where available for selling Member’s works showcased.
8.4 OPIPA and its Services may be temporarily unavailable from time to time for maintenance or other reasons. We assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of your communications.
8.5 We reserve the right to change any and all content, software and other items used or contained in the OPIPA and its Services offered through the OPIPA at any time without notice.
9. Proprietary Rights
9.1 All information, data, text, software, images, photographs, graphics, video, messages or other materials in OPIPA ("Content") or Member’s Content, are the sole responsibility of OPIPA or the respective right owners with all rights reserved. No Content or Member’s Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, without OPIPA or Member prior written permission.
10. Limited License
10.1 Third party websites and visitors are granted a limited license to access and use OPIPA, its Content or Member’s Content and to download or print a copy of any portion of the Content or Member’s Content to which they have properly gained access solely for their personal, non-commercial use, provided that they keep all copyright or other proprietary notices intact.
OPIPA reserves the right to immediately cancel membership with no refund given to any Member who;
11.1 Harasses another Member in any way, or uses this site to SPAM or send unsolicited emails to other Member.
11.2 Shows work that is not of his/her own design and creation or shows work that infringes on the copyright of other artists.
11.3 Publishes illegal Member’s Content or links to sites that are illegal, pornographic, racist or inflammatory, or otherwise violates the Terms & General Conditions.
12.1 You agree to indemnify, defend and hold OPIPA and it's owners and employees harmless, agents any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorney's fees, arising out of or in connection with any product you purchase after viewing it on OPIPA, or any content linked from OPIPA, or your use of OPIPA (including any uses under your Membership Account or Membership Name, whether or not authorized by you), your conduct in connection with OPIPA or with any Member, or any violation of these Terms & General Conditions or of any law or the rights of any third party. Please cooperate with us and contact us with any concerns you may have, or to report membership violations of the Terms & General Conditions.
13.1 We will record and keep Registration Data provided by you to use in our database.
13.2 Your Registration Data will be used to:
a) Introduced you and your work to every Member of OPIPA in order to vote for your Membership Request.
b) Enable us to construct your Member’s Website when you become a Member of OPIPA.
c) Enable us to keep direct contact with you during your Membership.
13.3 By providing Registration Data you consent to the use these, with due observance of the law, for activities such as analysis, improvement of the OPIPA and mailings of relevant information about the OPIPA or its services.
13.4 Your Registration Data will not be provided to third parties, unless necessary for technical reason or otherwise provided herein.
